I have yet to look at the props myself, so I'll be doing some homework in that area soon.

As to HOW I'm going to be voting... it'll be with a ballot!

Why? So far I am leaning the other way around. I am still trying to sort out the facts between these props. I am looking at who supports what props.

My first instinct is to vote no on both props and force the Legislature to do its job. Proposition after Proposition turns out to not be what the voters thought, on the basis of some soundbites and internet chain mails, they were voting for. Like the way the main beneficiaries of Prop. 13 turned out to be commercial property owners, who never die and rarely sell, so their property never gets reassessed on transfer.

What turns me off about 98 is the rent control Trojan Horse. As per the usual cynical special interest perversion of the initiative process, the real money and driving force behind 98 is the landlords. Rent control is not a good policy. I was involved in the rent control wars of the 80s, representing the apartment industry in the Legislature and the California and U.S. Supreme Courts. But I don't like the idea of sneaking it into an initiative which people will vote for out of their justifiable anger over the Kelo decision upholding the taking of people's homes in a non- blighted area so a developer can build a shopping mall and produce more taxes for the county supervisors to spend. And I think it unwise to cast one particular approach to phasing in vacancy decontrol in stone by initiative, which makes it difficult if not impossible to adjust the approach as market experience teaches new lessons.

99 deals with the Kelo problem which is what the voters want to deal with, without a Christmas tree of other sub voce agendas tacked on.

Both Schwarzenegger and Pete Wilson have spoken out against 98 as going too far and endangering not just private development masquerading as "redevelopment," which 99 will take care of, but also public works projects. Central Valley farmers have split off from the Farm Bureau, a rare fracture of solidarity, because they see the risk to water projects.

Isn't there a fair argument that Prop. 98, since it covers both eminent domain and rent control, violates the one subject rule of Article II, Section 8(d) of the California Constitution: "An initiative measure embracing more than one subject may not be submitted to the electors or have any effect"?
