He isn't building or repairing carts there. He has that done elsewhere. He's essentially a broker, he orders carts for people, gets them a better deal than they'd get on their own. Jerry and his wife are great people; however, do we enforce the rules for some and not others? That's when it's time to delete all the CC&Rs, period. We can not keep them "only" for our friends and close neighbors. apparently, we have. . .and will likely continue to do so.

If you examined this under the 'nuisance' rubric you'd find that every neighbor with 200 feet is delighted Jerry's where he is and doing what he's doing.

The flyer may give the impression he has that whole fleet of carts at the house. He usually has his own plus one he's cleaning up to show plus sometimes another one already sold and waiting for the buyer to pick up.

If you drive by during the day it's a tidy house with a nice golf cart in the driveway. Standard RM driveway scene. A for sale sign on the windshield. This is behavior we tolerate all over the place. So there is no uneven enforcement. The business activities rule essentially cooks down to "be pretty damn invisible." But for his notoriety as a great guy who gets great deals, you wouldn't notice as you drove by. That's the gold standard IMO on the business rule.

It sure seems like the spirit of the law is being twisted here. If somebody has an ax to grind step up and say it, don't hide behind some small possible rule. At the end of the day we all live here, so relax if does not bother his immediate neighbors why should it bother others, if in fact there is even a violation.
Should we all become compliance officers? Should we see if anybody is renting a room out. I've seen ads. Nobody is bothered. What about garbage cans left out more than a day. I am guillty. I know a guy that leaves his garage open more than entering and leaving.
All in all I like living here, even with its violations

I don't wish to live in Stepford. I didn't buy a house in Stepford. In the community I bought into the rules were applied judiciously and only when an activity clearly stepped over the line. It's worked so far.

This sounds an awful lot like what I said about Wilbur's lawsuit against Exclusive Use. Many of you were patting him on the back, the same issue applies here. I don't need to vote on EU for someone who lives a mile away, but Wilbur thinks we do. Now his neighbor is running a used golf cart business out of his garage and everyone is like, it doesn't affect me. Neither does EU if it isn't your neighbor, so why did you all care so much about that?

Wilbur isn't the only that thinks we do. It is the law.

The common areas are a community asset. The community should be able to have input into how that community asset is used. That is why I care.

Perhaps, but it's a law designed to force you to spend money for no apparent reason. The BOD thought our CC&R's addressed the issue as far as not needing a vote because of a past vote, and it worked fine. Now we have to have an election of the entire community for anyone to have EU no matter what, I hope for Wilbur's sake, or anyone else in his family, he or they never wants EU, talk about gathering proxies. I'd be all over that.
